StepGenie — Terms of Use

StepGenie is an AI‑driven USMLE prep tool with a QBank, an LLM chatbot, a USMLE Bingo knowledge‑gap analyzer, and Keyword Decks to reinforce pattern recognition. Because it uses generative AI, it can produce mistakes, omissions, or outdated information. Always double‑check outputs with trusted sources and your own judgment. StepGenie provides educational content only—it is not medical advice and must not be used for patient care.
1) Acceptance of These Terms
These Terms of Use (the "Terms") are a binding agreement between you ("you" or "User") and MAKAI HEALTH CORP, located at 1412 Market Street, San Francisco, CA 94102 ("StepGenie," "we," "us," or "our"). By creating an account, accessing, or using StepGenie websites, apps, browser extensions, APIs, or other services (collectively, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2) Who May Use StepGenie
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you are under 18, you represent that you have parental/guardian consent. You may use the Service only in compliance with these Terms and all applicable laws, including academic‑integrity and exam‑policy rules.
3) Educational Use Only; No Medical Advice
StepGenie provides educational content for standardized test preparation. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional judgment. Do not use the Service to make clinical decisions or to provide/modify patient care. In an emergency, call your local emergency number.
4) About the AI (Important Disclaimers)
StepGenie uses generative AI models. They may generate incorrect or misleading information ("hallucinations"), reflect biases, omit citations, or present non‑deterministic outputs for the same inputs. You are responsible for verifying the accuracy, appropriateness, and timeliness of all outputs before relying on them for study or any purpose.
- No guarantees of accuracy or outcomes. Even if an internal assessment achieved strong results (for example, an internal USMLE‑style evaluation scoring 100%), such results are not guarantees of accuracy, completeness, or your exam performance.
- Date and guideline drift. Medical knowledge changes. Content may become outdated. Cross‑check with official, current primary sources.
- Sensitive data caution. Do not enter protected health information (PHI), personal data of others, or confidential/third‑party proprietary information into prompts.
5) Service Features
QBank with LLM Chatbot. The QBank includes explanations and an optional AI chatbot to discuss questions, reasoning steps, and differential diagnoses for study purposes. The chatbot may produce errors; verify everything independently.
USMLE Bingo (Knowledge‑Gap Assessment). This feature surfaces patterns in your responses to highlight potential knowledge gaps. Outputs are heuristic and not definitive; use them to guide study, not to label competence.
Keyword Decks (Pattern‑Recognition Reinforcement). These spaced‑repetition and pattern‑reinforcement tools emphasize high‑yield phrases and associations. They do not replace comprehensive study or official resources.
We may add, modify, or remove features at any time.
6) Accounts and Security
You are responsible for your account, credentials, and all activity under it. Keep your password secure. Notify us immediately of any suspected breach. We may suspend or terminate accounts for suspected misuse or violation of these Terms.
7) Subscriptions, Trials, and Billing
If you purchase a paid plan, you agree to the pricing, billing frequency, and taxes presented at checkout. Subscriptions renew automatically until canceled. You can cancel renewal at any time in your account settings; access typically continues through the end of the current billing period. Any refund policy will be described at point of sale; otherwise, all fees are non‑refundable to the fullest extent permitted by law.
8) License and Intellectual Property
Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Service for personal, non‑commercial USMLE preparation. We (and our licensors) retain all rights, title, and interest in and to the Service, including software, models, interfaces, content (excluding your User Content), trademarks, and documentation.
You may not copy, modify, reverse engineer, decompile, disassemble, translate, or create derivative works of the Service; remove proprietary notices; or use automated means (bots, scrapers) without our prior written consent.
9) User Content; Feedback License
You may submit prompts, answers, notes, annotations, or other content ("User Content"). You represent you have necessary rights to submit User Content and that it does not infringe any third‑party rights or violate applicable law or exam rules.
You grant StepGenie a worldwide, royalty‑free, sublicensable license to host, process, display, reproduce, analyze, and create derivatives of your User Content solely to operate, improve, secure, and provide the Service, including model quality assurance, debugging, and personalization. If we ever wish to use User Content to train foundation models or for marketing, we will do so only as described in our Privacy Policy and/or with additional consent where required.
10) Acceptable Use; Academic Integrity
You agree not to:
- Use the Service for any unlawful purpose or to violate exam rules, honor codes, or institutional policies.
- Attempt to gain unauthorized access to the Service or related systems; probe or disrupt security or availability; or burden the Service with excessive automated traffic.
- Upload or input PHI, others' personal data, copyrighted material without permission, or confidential information you are not authorized to share.
- Use outputs to cheat on proctored or take‑home exams, or to circumvent exam security measures. Comply with USMLE®/NBME® policies at all times. StepGenie is independent and not affiliated with or endorsed by USMLE®, NBME®, FSMB®, ECFMG®, or any testing body.
11) Third‑Party Content and Services
The Service may reference third‑party materials or link to third‑party sites/services. We do not control and are not responsible for such materials or services. Your use of them is at your own risk and may be subject to third‑party terms.
12) Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to those practices. Do not input sensitive categories of personal data unless our documentation explicitly states we support such data and you have the necessary rights and consents.
13) Beta, Experimental, or Early‑Access Features
We may label some features as Beta or Experimental (including new AI models, USMLE Bingo iterations, and advanced reasoning chains). Such features may be incomplete, less reliable, or changed/removed without notice. You accept these limitations and the risk of errors.
14) No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT/OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR‑FREE, SECURE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STEPGENIE OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF USE, DATA, PROFITS, OR BUSINESS; OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNTS YOU PAID TO STEPGENIE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
16) Indemnification
You agree to indemnify and hold harmless StepGenie and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.
17) Suspension and Termination
We may suspend or terminate your access immediately if we believe you have breached these Terms or pose a risk to the Service, users, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution).
18) Changes to the Service or Terms
We may modify the Service and these Terms. If we make material changes, we will provide notice (e.g., by posting in‑product or updating the "Last updated" date). Your continued use after changes become effective constitutes acceptance. If you do not agree, discontinue use.
19) Governing Law; Dispute Resolution
These Terms are governed by the laws of California, USA, without regard to conflict‑of‑law principles. Any dispute arising from these Terms or the Service will be resolved by binding arbitration on an individual basis; class actions and jury trials are waived. You and StepGenie may seek injunctive or equitable relief in any court of competent jurisdiction to protect IP or prevent misuse.
20) Export and Sanctions Compliance
You may not use the Service if you are located in, under the control of, or a national/resident of any country subject to embargoes or sanctions, or if you are on any restricted‑party list. You agree to comply with export control and sanctions laws.
21) DMCA / IP Complaints
If you believe content on the Service infringes your copyright, please send a notice to our designated agent at manav@stepgenie.ai with the information required by 17 U.S.C. § 512(c)(3). We may remove content and terminate repeat infringers as appropriate.
22) Communications; Electronic Notices
You consent to receive electronic communications from us (e.g., emails, in‑app messages). Notices will be deemed given when sent or posted. You may manage communication preferences in your account settings.
23) Miscellaneous
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and StepGenie regarding the Service and supersede prior agreements on this subject. You may not assign your rights; we may assign ours in connection with a merger, acquisition, or sale of assets.
